These Terms of Service ("Terms") govern your access to and use of the TinyOffice platform, website, APIs, and services (collectively, the "Service") operated by TinyOffice ("Company," "we," "us," or "our"). By accessing or using the Service, you ("you" or "your") agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and capable of forming a binding contract to use the Service. By creating an account, you represent that all information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorized use.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.

You retain ownership of all data you submit to the Service ("Your Data"). You grant us a limited license to use, process, store, and transmit Your Data solely as necessary to provide the Service and as described in our Privacy Policy. You represent and warrant that you have all necessary rights and consents to provide Your Data, including any personal information of third parties (such as leads, prospects, or clients) that you input into the Service.
Certain features of the Service may require payment. All fees are stated at the time of purchase and are non-refundable except as required by law. We may change pricing at any time with reasonable notice. Payment processing is handled by third-party providers; we do not store full payment card numbers. Failure to pay may result in suspension or termination of your access.
The Service, including all software, designs, text, graphics, interfaces, and underlying technology, is owned by TinyOffice or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except for the limited license in Section 2.1. All rights not expressly granted are reserved.
The Service integrates with third-party platforms and service providers (including payment processors, email delivery providers, AI providers, lead enrichment services, cloud storage, scheduling platforms, and others). Your use of these integrations may be subject to the respective third party's terms and policies. We are not responsible for the availability, accuracy, or practices of any third-party service.
The Service includes features powered by artificial intelligence and machine learning ("AI Features"), including but not limited to meeting preparation briefs, email drafting, lead scoring, sentiment analysis, anomaly detection, and conversational AI tools. AI Features are provided through third-party AI service providers.
AI technology has inherent limitations. AI-generated outputs may contain inaccuracies, fabricated information, errors, biases, or omissions. We make no representations or warranties regarding the accuracy, reliability, completeness, or fitness for purpose of any AI-generated content. You are solely responsible for reviewing, verifying, and evaluating all AI outputs before use or reliance.
AI Features do not constitute professional business, legal, financial, accounting, or technical advice and should not be treated as such. The Service is designed to assist human decision-making, not replace it.
To provide AI Features, data including lead information, meeting details, communication history, and user-generated content may be transmitted to third-party AI service providers. We use API-tier access, meaning your data is not used to train third-party AI models under their current API data usage policies. We do not control and are not responsible for changes to third-party provider policies.
Certain AI Features operate on automated schedules (such as meeting preparation briefs and pattern recognition). By using the Service, you consent to this automated processing. AI Features are not used to make decisions that produce legal or similarly significant effects on individuals without human review.
THE SERVICE, INCLUDING ALL AI FEATURES, IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TINYOFFICE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TINYOFFICE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO TINYOFFICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
You agree to indemnify, defend, and hold harmless TinyOffice and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms or any applicable law; (c) data you submit through the Service that infringes the rights of any third party; or (d) your reliance on any AI-generated output.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Sections 4, 7, 8, 9, 11, and 12 survive termination.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in California. You consent to the personal jurisdiction of such courts. To the extent permitted by law, you waive any right to participate in a class action or class-wide arbitration.
